Mohamed Shaban is a Senior Associate at Hassan Radhi & Associates with extensive experience in dispute resolution and legal advisory work. His practice focuses primarily on civil and commercial litigation, insurance and reinsurance, banking and financial disputes, employment matters, and domestic and international arbitration.
Mohamed regularly represents local and international clients before the courts of Bahrain and advises insurers, financial institutions, corporations and other commercial clients on complex contentious and non-contentious matters. His experience includes preparing and conducting court proceedings, advising on contractual and regulatory issues, drafting legal opinions, reviewing commercial agreements, and assisting clients in the management and resolution of high-value and technically complex disputes.
He holds a Bachelor of Laws from the University of Bahrain and a Master of Science in Islamic Finance from Coventry University. He also holds the Advanced Diploma in Islamic Finance from the Bahrain Institute of Banking and Finance and a CMI Level 7 qualification in Strategic Management and Leadership. Mohamed has contributed to international legal publications addressing Bahraini law, including publications concerning insurance and reinsurance, employment law and dispute resolution. He works fluently in both Arabic and English.
Hassan Radhi & Associates' disputes practice is retained by clients in a number of commercial, shareholder, financial, and regulatory disputes, and fields a track record in appearing before the ICC, LCIA, and other bodies. Mohsin Al Alawi heads the team, bringing expertise in acting for clients at the appellate level, including the Cassation and Constitutional Court. He is ably assisted by Mohamed Shaban, who boasts broad experience in commercial disputes, including contractual, insolvency, and claims disputes.
Experience and Responsibilities (2018– to date):
Mohamed has been practising with Hassan Radhi & Associates since 2018 and has developed broad experience in contentious and advisory matters arising under Bahraini law. His practice is principally focused on civil and commercial litigation, insurance and reinsurance, banking and financial services, insolvency and restructuring, employment, corporate disputes, contractual claims and domestic and international arbitration.
He regularly represents local and international companies, financial institutions, insurers, reinsurers, investment firms, contractors, employers and other commercial clients before the courts of the Kingdom of Bahrain. His experience covers proceedings at different stages of litigation, including the commencement and defence of claims, interlocutory and urgent applications, appeals, applications for reconsideration, enforcement proceedings and other post-judgment measures. He is also experienced in handling matters involving the recognition and enforcement of foreign judgments and arbitral awards, including related attachment and execution proceedings.
Mohamed has acted in a wide range of complex commercial disputes involving breaches of contract, non-payment, termination, professional liability, commercial negligence, insurance coverage, policy interpretation, indemnity claims, subrogation and recovery actions, banking transactions, investment arrangements, financing disputes, shareholder relationships, insolvency, construction projects, supply and service agreements and employment relationships. His work frequently requires the analysis of extensive contractual records, financial documents, technical reports and expert evidence.
A significant part of Mohamed’s practice relates to insurance and reinsurance. He advises insurers, reinsurers, policyholders and other stakeholders on coverage disputes, policy exclusions, notification requirements, indemnity issues, liability claims, professional indemnity, property damage, motor insurance, recovery rights and disputes arising from the handling, settlement or rejection of claims. He also represents clients in related court and arbitral proceedings and prepares detailed legal opinions on the interpretation and application of insurance policies under Bahraini law.
In the banking and financial services sector, Mohamed advises and represents banks, investment institutions, finance companies and corporate clients in disputes arising from credit facilities, financing arrangements, investment products, securities, guarantees, debt recovery, enforcement and regulatory obligations. His experience includes matters involving complex financial structures, cross-border transactions and claims requiring the detailed examination of banking, accounting and valuation evidence.
Mohamed also has substantial experience in employment matters, acting for employers and employees in disputes concerning termination, contractual entitlements, remuneration, leave, end-of-service benefits, restrictive covenants, confidentiality and workplace obligations. In addition to representing clients in litigation, he advises on the interpretation of employment contracts, internal policies and the practical application of Bahraini labour law.
His arbitration experience includes acting in domestic and international proceedings involving contractual, insurance, construction and commercial disputes. He assists clients throughout the arbitral process, including the assessment of claims and defences, preparation of pleadings, review of evidence, coordination with experts, procedural applications, hearings and enforcement. He also serves as an arbitrator and has participated in professional and academic arbitration initiatives.
Mohamed regularly prepares legal opinions on complex and commercially sensitive questions of Bahraini law. His advisory work includes reviewing commercial agreements, assessing litigation and regulatory risk, advising on contractual interpretation and termination, evaluating potential exposure, developing dispute-resolution strategies and assisting clients in negotiations and settlement discussions. His approach is focused on providing clear, practical and commercially informed advice while preserving the client’s legal position.
Many of the matters handled by Mohamed involve a cross-border element and require coordination with foreign counsel, international clients, technical experts, accountants and other professional advisers. He works in both Arabic and English and is experienced in preparing legal opinions, pleadings, submissions and contractual documents in both languages.
